Pursuant to Governor Newsom's Executive Order N-29-20, members of the City Council and staff participated in this meeting via teleconference. In the interest of maintaining appropriate social distancing, members of the public also participated in this meeting electronically.

REGULAR MEETING

1.

CALL TO ORDER / PLEDGE OF ALLEGIANCE - The meeting of the City Council was called to order by Mayor John Marchand at 7:00 pm, held via teleconference using Zoom and YouTube.

1.01 ROLL CALL - Present: Mayor John Marchand, Vice Mayor Bob Woerner, and Council Members Robert W. Carling, Bob Coomber, and Trish Munro.

PROCLAMATIONS AND PRESENTATIONS

2.01 Presentation by Karen Cowan, Assistant Executive Director of the California Storm Water Quality Association (CASQA), awarding the Outstanding Sustainable Stormwater Project or Program Award to the City of Livermore, Zone 7 Water Agency, City of Pleasanton, and the Livermore Area Recreation and Park District for the Living Arroyos and Adopt a Creek programs.

Assistant Executive Director of the California Storm Water Quality Association Karen Cowan provided the presentation.

2.02 Proclamation recognizing October as Bullying Prevention Month and October 21, 2020 as Unity Day.

Mayor Marchand presented the proclamation.

CITIZENS FORUM

Jim Mackinac provided comment requesting the status on the restoration of the bike path on the levy behind Forest Glade Estates.

4.

CONSENT CALENDAR

ON THE MOTION OF CM MUNRO, SECONDED BY CM COOMBER, AND CARRIED ON A 5-0 VOTE, THE CITY COUNCIL APPROVED THE CONSENT CALENDAR.

4.01 Approval of draft minutes - June 22, 2020 - regular meeting.

4.02 Adoption of Ordinance 2105 amending and restating Chapter 15.20 Dangerous Buildings and amending portions of, and adding to, Chapter 8.15 Procedure for the Abatement of Public Nuisances in Livermore Municipal Code.

4.03 Resolution 2020-171 awarding and authorizing an agreement with S&H Construction, Inc. for the Water Reclamation Plant Occupied Building Repairs - Phase 1, Project No. 2015-19 in an amount not-to-exceed $2,168,000.

4.04 Resolution 2020-172 authorizing execution of an agreement with Pacific Gas and Electric Company for special facilities required for the Water Reclamation Plant Emergency Generator Project No. 2015-22 in an amount not-to-exceed $131,116.

4.05 Resolution 2020-173 authorizing a supplemental appropriation of $7,000 in Facilities Rehabilitation Program Funds in Fiscal Year 2020-21 and authorizing the acceptance for permanent maintenance and release of the security bonds, reduction of the labor and materials bond, and execution of a Notice of Completion for the Police Facility Evidence Storage Freezer, Project No. 2018-45.

PUBLIC HEARINGS - NONE.

6.

MATTERS FOR CONSIDERATION

6.01 Oral report from the Director of Emergency Services regarding the COVID-19 emergency, its impacts, and the governmental operations in response to that emergency, as well as discussion and direction regarding the City's emergency operations in response to that emergency.

Recommendation: Staff recommended the City Council receive the report and provide direction regarding governmental operations in response to the COVID-19 emergency.

Director of Emergency Services Marc Roberts presented the staff report.

Mayor Marchand invited public comment.

Jackie Cota provided comments in opposition of masks and urged City Council to reopen schools and businesses.

Brittni Kiick provided comments regarding the need for Police officers to wear masks.

There were no more public comments received and the public comment period was closed.

In response to questions from Mayor Marchand related to comments from Mrs. Cota, Mr. Roberts clarified that that non-compliance with County or State orders related to COVID-19 by local businesses could result in the loss of their business permit. He also clarified that even if the City reopened, businesses would still be subject to the State and County orders.

In response to questions from Vice Mayor Woerner, Mr. Roberts stated that communities of color seemed more impacted by COVID-19. He explained that staff was working to ensure information was communicated in a variety of languages and was working with the school district to disseminate information.

Council Member Munro urged residents to wear masks and to make sure they fit properly.

In response to questions from CM Munro, Mr. Roberts stated that any information related to staff not wearing masks could be sent directly to the City Manager's office (email is available on the website). He also stated the City does not currently have a program to help residents get masks that fit properly.

CM Munro requested that staff continue to monitor mask compliance and determine if an additional program may be needed.

CITY COUNCIL RECEIVED THE PRESENTATION.

6.02 Update on the Fiscal Years 2019-21 City Council Goals and Priorities.

Recommendation: This report is for information only.

City Manager Marc Roberts presented the staff report.

Mayor Marchand invited public comment.

Stephen Dunbar provided comments thanking City Council and staff for all their work.

There were no more public comments received and the public comment period was closed.

CITY COUNCIL RECEIVED THE PRESENTATION.

6.03 Discussion and direction regarding the 2020 National Citizen's SurveyT.

Recommendation: Staff recommended the City Council provide direction regarding the inclusion of specific, closed-end policy questions in the upcoming National Citizen SurveyT, which is scheduled for data collection November through December 2020.

Deputy City Manager Christine Martin provided the presentation.

In response to CM Carling, Mrs. Martin clarified that the survey sample would be statistically valid and random to reach all parts of the community.

In response to CM Munro, Mr. Roberts stated that the survey would oversample small populations to ensure they were accurately represented. Black, Hispanic, and geographically well represented would be included.

Mayor Marchand invited public comment.

Mary Perner asked if Native Americans would be included in the sample.

There were no more public comments received and the public comment period was closed.

In response to comments from Mrs. Perner, Mrs. Martin stated that she was unsure if Native Americans were included but she would inquire.

VM Woerner encouraged residents to complete the survey. He also asked Council to consider the following questions:

1. To what extent has the pandemic influenced answers to the survey?

2. As a result of telecommuting, to what extent should the City provide resources to employers letting employees telecommute at least a fraction of the time?

3. To what extent do citizen's support Valley Link?

CM Munro, spoke in support of Question 1 with the addition of the impact of the Fires. She was also interested in a question addressing equity and inclusion and suggested getting input from the E&I working group. She recommended a question regarding housing and population changes that have taken place or may take place.

CM Carling provided topics that could be used to create questions including: Valley Link, COVID, Climate, Equity & Inclusion from social justice point of view, housing, and what people think of the support of viticulture in Livermore.

Mayor Marchand spoke in support of Question 1, a Viticulture question, and a social justice question.

CITY COUNCIL GAVE DIRECTION TO STAFF TO INCLUDE THE FOLLOWING QUESTIONS:

1. To what extent do you approve of the City taking local action to combat climate?

2. How did the disasters in 2020 including COVID and fires impact your answers to the survey?

3. What is the best way we can engage with you so you feel heard? (provide approx. 5 options)

COUNCIL COMMITTEE REPORTS AND MATTERS INITIATED

7.01 Council Committee Reports and Matters Initiated by City Manager, City Attorney, Staff, and Council Members.

Equity and Inclusion Subcommittee CM Munro and VM Woerner noted their attendance at the subcommittee meeting.

League of CA Cities Annual Conference CM Munro and CM Carling noted their attendance at the conference from October 7-9, 2020.

Innovation Tri-Valley CM Munro and Mayor Marchand noted their attendance at the meeting on October 9, 2020.

National Night Out CM Munro, VM Woerner, and Mayor Marchand noted their attendance at the event on October 6, 2020.

East Bay Community Energy (EBCE) CM Munro explained that the resilient home program is limited time program for residents that have solar panels.

Stockmen's Park CM Munro shared that the park would be opening soon.

Housing Meeting CM Carling noted his attendance at a meeting related to housing in Burlingam.

Real Race Equity and Leadership CM Carling noted his attendance at the meeting

Virtual Workforce CM Carling noted his attendance at a meeting discussing virtual work environments being the new normal.

Street Changes CM Carling noted his attendance at a meeting related to street changes to accomplish various goals such as adding bike lanes, pedestrian cross walks and slowing traffic.

CalPERS CM Carling noted his attendance at the Mayors and Council Members meeting discussing the future of CalPERS.

Homelessness Subcommittee CM Carling invited residents to attend the upcoming meeting on October 15th at 6:00pm.

City Health Agency VM Woerner received consensus and directed staff to cooperate with other Tri-Valley Cities regarding the exploration of becoming its own health department.

Alameda County Transportation Commission (ACTC) Mayor Marchand noted his attendance at the October 12, 2020 Multi-Modal Committee Meeting.

Graffiti and Litter Abatement Daily (GLAD Program) Mayor Marchand requested and received consensus for staff to explore re-energizing the program.

State of the City Mayor Marchand invited residents to attend the State of the City on October 13, 2020 at 6:00pm.

Council Chambers Mural Mayor Marchand requested and received consensus to have the Commission for the Arts look into commissioning a Wine Country themed mural on the black grate in the Council Chambers.

ADJOURNMENT - at 9:18 pm in memory of Mike Biondi to a special meeting - closed session on October 19, 2020 and a regular City Council meeting on October 26, 2020 at 7:00 pm, held virtually via Zoom.
